It is very sad and disheartening to hear that Mahmadali Hayit, a political prisoner, has been tortured. Today (11.03.2019) M. Hayit’s spouse reported to BBC that her husband has been subjected to tortures for the last three years and his situation is very concerning. Savriniso Juraeva, Mahmadali Hayit’s spouse, mentioned the name Nuriddin Rahmon. He was the deputy of Izatullo Sharipov, the former head of the Main Directorate for the Execution of Criminal Sentences of the Ministry of Justice of the Republic of Tajikistan, and constantly tortured him.
Hayit said: “He (Nuriddin Rahmon) wants me to admit in front of the camera that I used to attract terrorists to the party (IRPT), and to admit that young people were joining ISIS as per my instructions. They constantly force me to testify against the IRPT and its chairman. Even if they kill me, I will not go for it, because I am pure before God and before my people. I never broke the law and abode by the constitution.” M. Hayit looked exhausted and showed signs of torture and cruel treatment on his face.
It should be mentioned that he never complained about conditions of detention and the treatment. He didn’t want his relatives, especially his old mother, to worry. Finally, continuous torture reached a level that made Hayit tell his spouse about unbearable conditions and constantly increasing torture and bullying during his last appointment with her.
Thereby, the National Committee for the Release of Political Hostages and Prisoners of Tajikistan reminds that this case of torture is not the only one in the county. It is worth to remind that even representatives of the Department of Corrections recognized torture and humiliation or degradation of prisoners as a cause of the prison riot in Khujand.
Today not only the Tajik people, but also most of international human rights organizations know that political prisoners in Tajikistan are not guilty and are prosecuted on false charges. Even the UN after examining dossier of M. Hayit recognized him innocent and demanded from the Tajik authorities to release him and grant him compensation by November 8, 2018. Unfortunately, the authorities of Tajikistan disregarded recommendations of the UN.
Thereby, our Committee, calls upon relevant state structures, human rights organizations, civil society, the UN and all those for whom human rights have value:
a) add to the sanctions list those responsible for the use of torture in prisons and detention centers in Tajikistan, confiscate their property abroad in favor of the victims;
b) to impose sanctions on the law enforcement bodies of Tajikistan by donor states and human rights organizations, as well as to halt further economic assistance from these structures;
с) prosecute Nuriddin Rahmon;
d) recognize as an accomplice and prosecute Izatullo Sharipov, the former head of the Main Directorate for the Execution of Criminal Sentences of the Ministry of Justice of the Republic of Tajikistan.
The National Committee for the Release of Political Hostages and Prisoners of Tajikistan announces that it will take all the facts and clues to the international court, if the authorities of Tajikistan don’t refrain from torturing, humiliation and degradation of prisoners, don’t prosecute the above-named individuals.
In order to internationalize this matter and demonstrate the real criminal face of the Tajik authorities, for which the UN recommendations mean nothing, the Committee will organize series of protests in front of the offices of the UN in Europe, embassies of Tajikistan in European countries.
