The National Committee for the Release of Political Hostage and Prisoners of Tajikistan (NCRPH) expresses its categorical protest over the illegal detention and arrest of Mr. Mahmurod Odinayev, deputy chairman of the Social-Democratic Party of Tajikistan (SDPT).
On December 7 the court of Hisor region, having arrested an opposition politician for 2 months, acted as a Stalinist trio and executor of the will of the General Prosecutor’s Office, not caring about observance of law and procedural norms. According to SDPT head Mr. Rakhmatillo Zoirov, Mahmurod Odinayev still has no lawyer. In this way, the Tajik authorities continue the practice of secret trials of dissenters.
The decision of the Hisor court was the third consecutive gross violation of the law against one of the leaders of the legal opposition, Mahmurod Odinayev. Earlier, on December 5 the General Prosecutor’s Office brought charges against him for hooliganism under Article 237 of the Criminal Code of Republic of Tajikistan. The General Prosecutor’s Office of Tajikistan took this accusation out of its own interpretation of the verbal protest of the opposition politician against lawlessness committed by the authorities.
Independent lawyers note that in the protest of Mahmurod Odinayev near the building of military committee of Hisor city on October 29, 2020 in connection with abduction of his unfit son for service in the army there is neither crime nor administrative violation.
Finally, another brutal illegal act was the forcible detention of Mahmurod Odinayev by an armed grab group, as a result of which he was tortured and injured.
We consider that the real reason for persecution of Mahmurod Odinayev was not his protest near the building of military commission on October 29, but his notice to the mayor of Dushanbe dated November 16, 2020 in Facebook about intention to hold meeting against police arbitrariness, growth of prices and impoverishment of population of Tajikistan.
The political motivation of the prosecution of Mahmurod Odinayev is confirmed by the active participation of the General Prosecutor’s Office in a regular case under the hooliganism article.
The National Committee for the Release of Political Hostage and Prisoners demands that the Tajik authorities immediately release Mahmurod Odinayev, who was another victim of political repression.
We demand that the lawyer be allowed to see the illegally arrested person immediately. We demand the immediate transfer of the injured Odinayev to the civilian hospital.
We call on human rights organizations and citizens to support our demands in the most active way and express solidarity with Mahmurod Odinaev.
